Zoning Ordinance & Maps
PURPOSE AND INTENT
2.01 PURPOSE
This Ordinance is adopted to the end that:
- Adequate light, pure air and safety from fire and other danger may be secured;
- The taxable value of land and structures throughout the Village may be conserved;
- Congestion in the public streets may be lessened or avoided;
- The hazards to persons and damage to property resulting from the accumulation or runoff of storm or flood waters may be lessened or avoided; and
- The public health, safety, comfort, morals, and welfare may otherwise be promoted.
2.02 INTENT
To achieve these ends, the Ordinance sets forth regulations and standards to:
A. Regulate and limit the height and bulk of buildings hereafter to be erected;
B. Establish, regulate, and limit building set-back lines along street lines or storm or flood-water runoff channel or basin;
C. Regulate and limit the intensity of the use of lot areas, and to regulate and determine the area of open spaces, within an surrounding such buildings;
D. Classify, regulate, and restrict the location of trades and industries and the location of buildings designed for specific industrial, business, residential, and other uses;
E. Divide the entire municipality into districts of such number, shape, area, and of such different classes as may be suitable;
F. Fix standards to which structures therein shall conform;
G. Prohibit uses, buildings, or structures incompatible with the character of such districts;
H. Prevent additions to, and alteration or remodeling of, existing structures in such a way as to avoid the restrictions and limitations lawfully imposed under this Ordinance;
I. Regulate and limit the intensity of the use of lot areas;
J. Regulate and determine the area of open spaces within and surrounding buildings hereafter erected on a lot;
K. Establish standards to which buildings or structures shall conform;
L. Prohibit uses, buildings, or structures incompatible with the character of Residence, Business, or Office-Research-Assembly districts;
M. Provide the gradual elimination of buildings, structures, and uses which are incompatible with the character of the districts in which they are located, including, without being limited to the elimination of: (a) uses of unimproved lands or lots when the existing rights of the persons in possession thereof are terminated, or when the uses to which they are devoted are discontinued; (b) uses to which such buildings and structures are devoted, if they are adaptable for permitted uses; and (c) such buildings and structures when they are destroyed or damaged in major part as provided hereinafter, or when they have reached the age fixed herein as the normal useful life of such buildings or structures;
N. Provide for the acquisition of any building or structure which does not conform to the standards fixed by the Village of North Riverside;
O. Define and limit the powers and duties of the administrative officers and bodies as provided hereinafter; and
P. Prescribe penalties for the violation of the provision of this Ordinance, or of any amendment thereto.
